Frequently Asked Questions
This sounds too good to be true, how is this plan compliant?
We have gone to great lengths to ensure the compliance and viability of this plan. To get some of the details, read this article published by Emily Langdon, a Partner/Shareholder of the Fraser Stryker Law Firm. Emily is an employee benefits, ERISA, & executive compensation specialist.
Would this require modification or replacement of my current plan(s)?
No. The Champ Plan goes on top of your existing plan with no coordination of benefits. Additionally, for companies who do not currently have a plan, Champ can operate as a standalone.
My company has less than 100 employees, does that mean I can’t participate?
No. We gladly provide the Champ Plan to all companies with greater than 5 full-time employees. For smaller operations, we do have additional coverage options, so make sure you reach out!
How does this plan provide care while creating tax savings in a compliant manner?
This plan has been designed as a Section 125 Cafeteria Plan, which under IRC guidelines is tax deductible.
Can we see the specific legal opinions substantiating the legal operation of the plan?
Yes, we have multiple opinions and are able to make those available in a controlled context.
Will this plan hurt my employees retirement contributions?
While there is a slight decrease in Social Security contributions, 401(k)’s and other funds are not touched. This plan has been evaluated by ERISA specialists and calculated to provide a net benefit to employees.
How does Champ substantiate each claim?
Each employee action is recorded with a Common Procedural Terminology (CPT) code and generates a complete Explanation of Benefits (EOB).
How many employees are currently being provided Champ benefits?
Over 840,000 nationwide.
Is this a Wellness Program or an IRC Section 105 Reimbursement plan?
NO. This plan has been specifically designed as a section 125 cafeteria plan which is also in compliance with sections 104, 105, & 106. Additional information is available through the legal opinions regarding our plans which can be viewed by scheduling a meeting with us above.
Is there a net cost for the employee or employer?
There is a cost to both the employer and employee to fund and participate in the plan, however the plan savings have been calculated to outweigh the expenses in most cases. Champ will provide a Guaranteed Impact Statement showing the impact on each employee and the business as a whole so you can see exactly how your business will be affected before moving forward.
Who qualifies for this plan?
All employees are able to participate in this plan regardless of preexisting conditions as long as they earn enough on a monthly basis to cover the plan deduction. Employees who will see a positive financial impact are automatically enrolled (they can opt out at any time).
How does Champ avoid double-dipping concerns?
The Champ Plan is an Employee-funded, Employer-sponsored, Limited Schedule of Benefits plan in which the Employee must pay a post-tax premium to participate. More information is available here.
