With your assistance and hard work, as well as the work of our coalition partners, we achieved several very significant legislative victories including:

Repeal of the five-percent statewide occupancy tax
This tax caused a significant loss of business in all segments of the industry. The repeal has made all New York destinations competitive once again. NYSH&TA continues to oppose any new industry taxes or fees. The result of the repeal is an estimated $227 million in additional tourism business.

Reform of the Worker's Compensation System
The antiquated Worker's Compensation System in New York state created skyrocketing insurance costs for businesses in almost every sector of the hospitality and tourism industry. With the reform of the Worker's Compensation System, a more business-friendly environment has been created in New York state, one that remains cognizant of the needs of the state's substantial work force. The estimate by Gov. George Pataki's office concerning the impact of these reforms represents a possible savings for employers of more then $1 billion per year.

Funding of the I Love NY program
NYSH&TA led the industry in successfully campaigning for an increase in the funding of the state's tourism promotion programs.

Revisions to the Bed & Breakfast Fire Code
This new law makes it easier for entrepreneurial owners of older homes to participate in New York's vital tourism industry and reduces the regulatory burden shouldered by our small businesses.

Amendments to Amusement Park Safety Regulations
This revision excluded open-sided structures, such as picnic shelters, from any sprinkler system requirements as set forth in the original regulation.

Amendments to Pool and Bathing Regulations
The association secured an amendment to the regulations that permitted temporary residence facilities to continue to use signage options after a change in ownership.

Revisions to the Security Guard Act
The association led the effort to amend this act which would have, among other requirements, forced industry businesses to become licensed security guard companies. The revisions significantly reduced the financial and administrative burdens on lodging and parks and attractions members.

Pending Issues
This year, working with the growing ranks of membership, NYSH&TA will address several issues of vital importance to the industry:

  • Minimum Wage. NYSH&TA strongly opposes legislation to increase the state's minimum wage, including automatic annual wage increases.
  • Increased State Tourism Promotion Funding. The association continues to pressure the administration and legislature to return the state's tourism advertising, marketing and matching funds programs to the preeminent national position they once held. The programs play a significant role in promoting our state's destinations to leisure, convention and business travelers.
  • Regulatory Issues. The association continues to monitor proposed regulatory changes such as pesticide application notification, which would place a burden on the hospitality industry.
